1. Agreement & Acceptance
Welcome to Powerband Inspections. By accessing or using our services, you agree to comply with these Terms & Conditions. Powerband Inspections may update these terms periodically, with continued use of services constituting acceptance of any changes. If you do not agree, please discontinue use immediately.
2. Service Terms
Services Provided: Powerband Inspections offers electrical inspection services, including but not limited to safety inspections, compliance checks, fault detection, and system evaluations. Service details are outlined in individual agreements or quotations.
- The agreement begins on the specified start date or, if undefined, on the date of service request.
- Annual or ongoing services are provided for a minimum of 12 months unless otherwise stated.
- Services may continue on a rolling annual basis unless terminated in accordance with the termination clause.
3. Eligibility
- You must be at least 18 years old and legally capable of entering into a binding contract to use our services.
- By using our services, you confirm that all information provided is accurate and complete.
4. Pricing & Quotations
- Prices are subject to change and will be invoiced based on the current rates at the time of service.
- Quotations are estimates based on available information and may be adjusted if additional requirements arise.
- Additional expenses agreed upon in advance will be reimbursed by the client.
4. Booking and Payment
- All service bookings must be confirmed in writing, via phone, or through our website.
- Payments must be made as per the agreed schedule outlined in the invoice.
- Late payments may incur additional charges, and non-payment may result in service refusal.
- Powerband Inspections reserves the right to adjust service pricing at any time, with prior notice.
4. Payment Terms
- Payments are due as per the invoice terms.
- Fees include GST unless stated otherwise.
- Credit card payments incur a 1.8% surcharge.
- Disputed charges must be notified in writing immediately upon receipt of the invoice.
5. Late Payments
Failure to pay on time may result in:
- Suspension of services
- Immediate legal action for outstanding amounts
- Termination of the agreement
- Late payment fees, not exceeding $50 per month or 2% of the invoice amount
6. Service Delivery
- Clients must provide necessary information and site access.
- Powerband Inspections will endeavor to meet delivery timelines but is not liable for delays.
- Any additional work beyond the agreed scope will be quoted separately and must be approved in writing.
7. Cancellations
- Cancellation fees may apply. If a scheduled inspection is canceled after commencement, up to 75% of the service fee may be charged.
- Full service fees apply if the job is canceled after completion.
6. Client Responsibilities
- Ensure that all relevant information regarding the electrical system is provided accurately.
- Maintain safe and accessible conditions for our inspectors to carry out their work.
- Any delays or obstructions caused by the client may result in additional charges.
7. Limitation of Liability
- Powerband Inspections is not responsible for any indirect, incidental, or consequential damages resulting from our services.
- Our liability is strictly limited to the amount paid for the specific service in question.
- We are not responsible for any future electrical issues arising after the inspection.
8. Inspection & Claims
- Any claims related to service discrepancies must be submitted in writing within 7 days of service completion.
- Risk of installed equipment transfers to the client upon installation.
9. Limited Warranty
- Powerband Inspections warrants that services are performed professionally and competently.
- A 3-year workmanship warranty applies to services rendered but does not cover product performance or manufacturer defects.
- If applicable, defective workmanship will be rectified at no cost.
10. Confidentiality and Data Protection
- We handle all client data in accordance with applicable privacy laws.
- Personal data is only used for service provision, internal record-keeping, and legal compliance.
- We do not share client information with third parties unless legally required.
11. Force Majeure
- Powerband Inspections is not liable for delays or failures in service due to unforeseen circumstances such as natural disasters, government actions, labor disputes, or other external factors beyond our control.
12. Amendments to Terms
- We reserve the right to modify these Terms & Conditions at any time.
- Clients will be notified of significant changes via email or updates on our website.
13. Governing Law
- These Terms & Conditions are governed by the laws of the jurisdiction where Powerband Inspections operates.
- Any disputes shall be resolved in accordance with the applicable local legal framework.
14. Indemnification
- Clients agree to indemnify and hold Powerband Inspections harmless from any claims, liabilities, damages, or expenses resulting from misuse of our services.
15. Intellectual Property
- All content, branding, and materials provided by Powerband Inspections remain our intellectual property.
- Unauthorized reproduction, distribution, or modification is strictly prohibited.
16. Termination of Services
- We reserve the right to terminate services if a client violates these Terms & Conditions or engages in unlawful activities.
- Any fees paid before termination are non-refundable unless stated otherwise.
17. Complaints and Dispute Resolution
- Clients can report concerns or complaints via our official contact channels.
- We strive to resolve disputes amicably, but if a resolution cannot be reached, legal action may be pursued in accordance with the governing law.
